Binding Contract
- Legal agreement: These Terms constitute a legally binding contract between you and WhatsNext Health, LLC ("we," "us," or "our")
- Acceptance required: By creating an account, accessing the Service, or using any features, you accept these Terms
- Age requirement: You must be at least 18 years old to create an account and use the Service
- Authority: If you are using the Service on behalf of a minor, you represent that you are their parent or legal guardian with authority to agree to these Terms
Changes to Terms
We may update these Terms from time to time. Material changes will be notified via email 30 days in advance. Continued use after changes constitutes acceptance.
If you disagree with changes, you must stop using the Service and may delete your account.
2. Description of Service
What WhatsNext Provides
WhatsNext is a digital platform designed to help parents and guardians navigate the autism and ADHD evaluation process. Our Service includes:
- Personalized journey roadmaps: Step-by-step guides tailored to your child's age, developmental stage, and location
- AI-powered guidance: Access to an AI assistant that provides informational guidance based on evidence-based practices
- Document management: Tools to organize, store, and manage evaluation reports, school documents, and medical records
- Provider directory: A directory of healthcare providers, therapists, and specialists (for informational purposes)
- Care team management: Tools to track and manage your child's care team members
- Evidence-based screening tools: Access to validated screening questionnaires (M-CHAT, Vanderbilt, SNAP-IV) for educational purposes
- Educational resources: Articles, guides, and resources about developmental evaluations and support
- Progress tracking: Track your journey progress, milestones, and action items
- Partner collaboration: "Plus One" feature to share access with one partner per child profile
What WhatsNext Is NOT
Important limitations:
- NOT a healthcare provider: We do not provide medical diagnosis, treatment, or healthcare services
- NOT a substitute for professional medical advice: Our platform is for informational and organizational purposes only
- NOT a diagnostic service: Screening tools and AI guidance are not medical diagnoses
- NOT HIPAA-compliant (currently): We are working toward HIPAA compliance but are not yet a HIPAA-covered entity
- NOT an emergency service: We do not provide emergency medical assistance or crisis support
- NOT legal or insurance advice: We provide general information only, not legal or insurance advice

3. Account Requirements
Eligibility
To create an account and use the Service, you must:
- Be at least 18 years old: The Service is designed for adults (parents/guardians)
- Provide accurate information: You must provide truthful, accurate, and complete information when creating your account
- One account per person: Each person should have their own account (except for invited partners via Plus One)
- Be a parent, guardian, or authorized caregiver: You must have legal authority to make decisions about the child's care
Account Security
Your responsibility:
- Keep password confidential: You are responsible for maintaining the confidentiality of your account credentials
- Notify us immediately: Contact us immediately if you suspect unauthorized access to your account
- You are responsible for all activity: All activity under your account is your responsibility, even if unauthorized
- Secure your device: Keep your device and browser secure and up to date
Partner Access (Plus One Feature)
When you invite a partner using the Plus One feature:
- One partner per child: You may invite one partner per child profile (based on subscription tier)
- Full access granted: Partner gains full access to shared child data (profiles, journeys, documents, action items)
- Your responsibility: You are responsible for who you invite - only invite people you trust
- Partner agreement: Invited partners must also agree to these Terms of Service
- Revocation: You can revoke partner access at any time
- Partner removal: Partners can remove themselves from access
We are not responsible for partner actions or misuse of shared access.
4. Subscription & Payment
Subscription Tiers
WhatsNext offers three subscription tiers:
- Free: Limited features, always available (no payment required)
- Essential: $19/month or $180/year - Enhanced features and support
- Premium: $39/month or $390/year - Full feature access and priority support

Billing
- Payment methods: Subscriptions are billed via Stripe (credit card, when implemented)
- Billing cycle: Monthly subscriptions bill monthly; annual subscriptions bill annually
- Auto-renewal: Subscriptions automatically renew unless cancelled before the billing period ends
- Price changes: We reserve the right to change prices with 30 days' notice to current subscribers
- Taxes: You are responsible for any applicable taxes
Free Trial
- Essential trial: 7-day free trial, no credit card required
- Premium trial: 14-day free trial, credit card required (not charged until trial ends)
- Trial cancellation: Cancel anytime during trial for no charge
- Auto-conversion: Trial automatically converts to paid subscription at trial end (unless cancelled)
Cancellation
- Cancel anytime: You can cancel your subscription at any time from Account Settings
- Access until period end: You retain access until the end of your current billing period
- No refunds: No refunds for partial months or years after cancellation
- Data retention: Data is retained according to our Privacy Policy after cancellation
Downgrades
- Downgrade anytime: You can downgrade your subscription tier at any time
- Effective date: Changes take effect at the start of your next billing cycle
- Feature access: Premium features are disabled immediately upon downgrade
- No refunds: No refunds for downgrade timing
Failed Payments
- Downgrade to Free: If payment fails, your account is automatically downgraded to Free tier
- Email notification: We send email notification of failed payment
- Grace period: 7-day grace period to update payment method
- Data retention: Data is retained during grace period
- Permanent downgrade: After grace period, account remains on Free tier
5. Acceptable Use
You May
- Personal, non-commercial use: Use the Service for personal, non-commercial purposes related to your child's evaluation journey
- Enter accurate information: Provide truthful, accurate information about yourself and your child
- Upload relevant documents: Upload evaluation reports, school documents, and medical records relevant to your journey
- Share with partner: Invite one partner per child using the Plus One feature (based on subscription tier)
- Provide feedback: Share feedback, suggestions, and report bugs to help us improve
You May NOT
Prohibited activities:
- Share account credentials: Do not share your account credentials with others (except invited partner via Plus One)
- Upload malicious files: Do not upload files containing viruses, malware, or malicious code
- Access others' data: Do not attempt to access, view, or modify other users' data
- Scrape or copy content: Do not scrape, copy, download, or reproduce platform content without permission
- Reverse engineer: Do not reverse engineer, decompile, or attempt to extract source code
- Illegal purposes: Do not use the Service for any illegal purpose or in violation of any laws
- Impersonation: Do not impersonate others or provide false information
- Harassment or abuse: Do not harass, abuse, threaten, or harm other users or our staff
- Spam or unsolicited messages: Do not send spam, unsolicited messages, or advertisements
- False information: Do not upload false, misleading, or fraudulent information
- Violate rights: Do not violate intellectual property rights or privacy rights of others
Violation of these rules may result in immediate account termination without refund.
6. Content & Intellectual Property
WhatsNext Content
- Ownership: All platform content, design, code, and intellectual property are owned by WhatsNext Health, LLC
- Protected by law: Protected by copyright, trademark, and other intellectual property laws
- Limited license: You receive a limited, non-exclusive, non-transferable license to use the Service for personal purposes
- License termination: This license terminates when you close your account or we terminate your access
- No ownership transfer: Using the Service does not grant you ownership of any content
Your Content
- You retain ownership: You retain ownership of content you upload (documents, notes, etc.)
- License to us: You grant us a license to store, process, and display your content as necessary to provide the Service
- Operational purposes only: This license is limited to operational purposes necessary to provide the Service
- No sharing or selling: We will not share or sell your content (except as described in Privacy Policy)
- Deletion: You can delete your content at any time
User Responsibilities
You are responsible for:
- Content you upload: Ensure you have the right to upload documents and content
- Copyright compliance: Do not upload copyrighted material without permission
- Legal content: Do not upload illegal, harmful, or inappropriate content
- Accuracy: Ensure uploaded content is accurate and relevant
We reserve the right to remove content that violates these Terms or our policies.
7. AI Assistant
AI Guidance
- Informational only: The AI assistant provides informational guidance only, not medical or professional advice
- Not a substitute: AI responses are not a substitute for professional medical, legal, or financial advice
- May contain errors: AI responses may contain errors, inaccuracies, or outdated information
- No guarantee: We do not guarantee the accuracy, completeness, or usefulness of AI responses
AI Limitations
The AI assistant cannot:
- Diagnose conditions: It cannot diagnose medical conditions
- Prescribe treatments: It cannot prescribe treatments or medications
- Provide emergency assistance: It cannot provide emergency medical assistance
- Guarantee outcomes: It cannot guarantee specific outcomes or results
Your Responsibility
You are responsible for:
- Verify information: Verify AI information with qualified professionals (doctors, therapists, etc.)
- Use as guidance: Use AI suggestions as guidance, not directives
- Consult professionals: Consult healthcare providers for all medical decisions
- Not rely solely on AI: Do not rely solely on AI for important decisions affecting your child's health or well-being
We are not liable for decisions made based on AI guidance.
8. Screening Tools
Educational Purpose
- Not diagnoses: Screening tools (M-CHAT, Vanderbilt, SNAP-IV) are provided for educational purposes only
- Results are not diagnoses: Screening results are not medical diagnoses
- Share with provider: Results should be shared with your healthcare provider for professional evaluation
- Professional evaluation required: A professional evaluation is required for diagnosis
Tool Accuracy
- Based on research: Tools are based on validated research and evidence-based practices
- Depends on accurate responses: Accuracy depends on honest, accurate responses
- False positives/negatives possible: False positives and false negatives are possible
- Not a substitute: Not a substitute for professional assessment by qualified providers
Your Responsibility
- Honest responses: Provide honest, accurate responses to screening questions
- Share results: Share screening results with your healthcare provider
- Follow professional advice: Follow your provider's recommendations, not just screening results
- Understand limitations: Understand that screening tools have limitations
We are not liable for decisions made based on screening results.
9. Provider Directory

- Informational purposes: Provider listings are for informational purposes only
- No endorsement: We do not endorse, recommend, or guarantee any specific providers
- Information may be outdated: Provider information may be incomplete, inaccurate, or outdated
- Verify independently: You must verify provider credentials, licenses, and qualifications independently
Your Responsibility
- Research providers: Research providers thoroughly before contacting or scheduling appointments

- Make informed decisions: Make your own informed decisions about which providers to use

- Your content or actions: Any content you upload or actions you take on the platform
12. Dispute Resolution
Governing Law
- North Carolina law: These Terms are governed by the laws of the State of North Carolina, USA
- Jurisdiction: Any legal disputes must be resolved in the courts of Guilford County, North Carolina
Informal Resolution

- Good faith attempt: We will attempt to resolve disputes in good faith within 30 days
- No legal action: Do not initiate legal action until after informal resolution attempt
Arbitration
Binding arbitration:

- AAA rules: Arbitration conducted under American Arbitration Association (AAA) rules
- Individual basis: Claims must be brought on an individual basis (no class actions)
- Location: Arbitration in High Point, NC, or via video/phone at your option
- Fees: Each party bears their own costs; we pay AAA fees for claims under $10,000
Exceptions to Arbitration
You may bring claims in court for:
- Small claims: Claims under $10,000 may be brought in small claims court
- Injunctive relief: Seeking injunctive relief for intellectual property violations
- Emergency situations: Emergency situations requiring immediate court intervention
Class action waiver: You waive any right to participate in class actions or representative proceedings.

Effect of Termination

- Data retention: Data retained and deleted according to Privacy Policy
15. General Provisions
Entire Agreement

Severability
